What does sustainable contracting look like?
Sustainable contracting can vary, depending on vision and what parties want to achieve together. It can mean making sustainability agreements that require compliance with certain standards. An example of this that may be considered familiar by now is of course the provision that supplied goods must be produced without the use of child labour. But also consider guaranteeing the lifespan of certain products and that there is a 'right to repair' if the product breaks down during this period or a 'obligation to recycle' after complete depreciation. This way, you ensure that products last longer and do not end up in landfill sites (too) quickly.
On the one hand, sustainable contracting looks at the creation and content of a contract; on the other hand, the design and, for example, the use of language are also important. In the creation and content of the contract, it may mean including provisions that integrate sustainability requirements. Think about using environmentally friendly materials, ensuring fair working conditions and reducing CO2 emissions during the life cycle of products or services.
In addition, it may include agreements on measuring, reporting and monitoring sustainable performance. You may consider a sustainable sanction for non-compliance in a sustainable contract. Instead of dissolution, you could think of paying compensation to a predetermined green or social cause. Do you plan to include this in the contract? If so, consider including a reward for meeting agreed sustainability targets.
Design and, for example, language are also important in a sustainable contract. You can also keep the contract simple and use clear language. This not only promotes readability, but also encourages open and honest collaboration between parties.
